Terms of Service

Please read carefully. Exclusive mailer campaigns are custom-produced for your business and become non-refundable once artwork is approved or production begins. Advertising exposure is delivered as described, but specific marketing results are not guaranteed.

1. Services

Community Spotlight Media (the “Company”) provides done-for-you direct mail advertising. An Exclusive Mailer Campaign includes design, printing, household targeting, mailing preparation, and postage for a 6" x 11" mailer dedicated entirely to a single business. Campaign size and target area are defined at purchase or during your campaign call.

2. Advertising Results

The Company provides advertising production and distribution services only. While every effort is made to maximize exposure, no guarantees are made regarding leads, calls, website traffic, sales, or return on investment. Results vary based on industry, offer, creative, competition, seasonality, and other factors outside our control.

3. Payment, Production & Refunds

Payment is due in full before production begins unless otherwise agreed in writing. Payments are non-refundable once artwork has been approved by the advertiser or production has begun, including submission to the printer or mailing house.

Before artwork approval and before production begins, a written cancellation request may be eligible for a refund less any design, targeting, or processing work already completed.

4. Multi-Campaign Plans

Three-campaign plans are sold as a package covering three separate mailings. Package pricing reflects the full commitment; completed campaigns are non-refundable, and remaining campaigns must be scheduled within twelve (12) months of purchase unless otherwise agreed in writing. Unused campaigns after that period may be forfeited.

5. Scheduling

Estimated production and mailing dates are provided in good faith but are subject to change due to design revisions, advertiser approval delays, printer schedules, USPS processing, weather, equipment issues, or other circumstances outside the Company's control.

6. Targeting and Household Counts

Target areas are selected based on your business, service area, and goals. Household counts are stated as approximate and as up to the purchased quantity. Because mail is distributed by carrier route or targeted address list, the final delivered count will land near — but rarely exactly at — the stated figure, and may be somewhat above or below it.

Any target area maps or examples shown on our website are for illustration only and do not represent a guaranteed mailing area.

7. Distribution

The Company will make commercially reasonable efforts to distribute your mailer to the agreed quantity of households. Distribution is performed through third-party print and mailing providers and the United States Postal Service. Exact delivery dates to individual households cannot be guaranteed.

8. Proof of Distribution

Upon request, the Company may provide available documentation confirming production and/or mailing, including printer confirmations, USPS documentation, or production photos, when available.

9. Artwork & Content Responsibility

Advertiser is responsible for the accuracy of all information provided (business name, phone, website, offers, licensing, disclaimers). Advertiser represents that it holds all necessary rights to any logos, images, or content submitted, and agrees to review and approve final artwork prior to production. Design includes a reasonable number of revision rounds prior to approval; extensive redesign requests after approval may incur additional fees.

The Company may decline or require changes to any advertisement that is unlawful, misleading, or inconsistent with our standards or mailing requirements.

10. Exclusivity

Each Exclusive Mailer Campaign features one business only — your mailer is never shared with other advertisers. Exclusivity applies to the specific mailer produced for you and does not restrict the Company from serving other businesses, including competitors, in separate campaigns or areas.

11. Limitation of Liability

To the maximum extent permitted by law, the Company's total liability for any claim arising out of or related to these services shall not exceed the amount paid by the advertiser for the specific campaign in question. The Company shall not be liable for indirect, incidental, consequential, or lost-profit damages.

12. Chargebacks

Because campaigns are custom-produced and mailed to third-party households, initiating a chargeback after artwork approval or production does not entitle the advertiser to a refund. The Company will provide documentation of these terms, artwork approval, and production/mailing to the card issuer as needed.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. The Company may update these Terms from time to time; the version in effect at the time of your purchase applies to that campaign.
